1. About these terms
These terms apply when you use fmoh.in (the "website") or any service offered by FMOH Consulting and Solutions Pvt Ltd ("FMOH", "we", "us"). By using the website, you agree to these terms. If you do not agree, please do not use the website.
2. What FMOH does
FMOH helps people find, build and furnish a home. We list properties that our team has inspected, introduce you to architects, interior designers and studios, and arrange home services through our Essentials partners.
Unless we agree otherwise in writing, FMOH is a facilitator. We are not the seller of any property, not the builder or designer of your home, and not a lender. Any sale, design contract or service agreement is between you and the seller, professional or partner concerned.
3. Using the website
- You must be at least 18 years old to send an enquiry or book a service.
- Information you give us must be accurate and your own, or shared with the permission of the person it belongs to.
- You may browse the website for your personal, non-commercial use.
4. Property listings
Before we publish a listing, our team visits the property and reviews the documents made available to us, including RERA registration where it applies. This review reflects what we saw at that time. It is not a legal title opinion, a structural survey or a guarantee.
- Listing details, prices and availability come from developers and owners and can change without notice.
- Photos, floor plans and illustrations may be indicative. Where an image is a render, we aim to label it as one.
- Before you commit to a purchase, please carry out your own checks, including on the Kerala RERA website where the project is registered, and take independent legal advice.
5. Enquiries, consultations and site visits
When you send an enquiry, request a callback, book a site visit or ask for a quote, you agree that we may contact you about that request by phone, WhatsApp, SMS or email, even if your number is registered on the Do Not Disturb list. You can ask us to stop at any time.
Sending an enquiry does not create any obligation to buy or to use a service.
6. Architects, designers and Essentials partners
Architects, interior designers, studios and Essentials partners listed on FMOH are independent businesses. We review them before listing, but we do not employ them and we do not guarantee their work.
- Any design, construction, installation or supply contract is between you and the professional or partner.
- Quotes, timelines, warranties and after-sales support are set by the professional or partner, and your FMOH advisor will share them with you.
- If something goes wrong, tell your advisor. We will help you raise it with the professional or partner.
7. Coming-soon services and the EMI calculator
Some services are marked "Coming soon", including home finance and health food subscriptions. They are not yet available, and signing up for updates does not reserve or guarantee a service, price or eligibility.
The EMI calculator gives an estimate using a standard formula. It is not an offer of credit, a loan approval or financial advice. FMOH is not a bank or a non-banking financial company. Your actual loan terms will be decided by the lender.
8. Fees
Browsing the website is free. If a service involves a fee from FMOH, your advisor will tell you the amount and what it covers in writing before you commit. Fees charged by professionals and partners are agreed directly with them.
9. Intellectual property
The FMOH name, logo, website design and content belong to FMOH or are used with permission. You may not copy, reproduce or reuse them for commercial purposes without our written consent. Project photos in professional portfolios belong to the professionals or their clients.
10. Acceptable use
You must not misuse the website. This includes submitting false enquiries, scraping listings or profiles, attempting to access systems without permission, or uploading anything unlawful, misleading or harmful.
11. Third-party services
The website links to or embeds services run by others, such as WhatsApp, Google Maps and YouTube. Those services are governed by their own terms and privacy policies.
12. Limitation of liability
We work hard to keep the website accurate and available, but we provide it "as is". To the extent permitted by law, FMOH is not liable for any indirect or consequential loss, or for decisions you make based only on information on the website. Nothing in these terms limits any liability that cannot be limited under applicable law, including your rights as a consumer.
13. Indemnity
If you breach these terms or misuse the website, you agree to cover reasonable losses FMOH suffers as a direct result, to the extent permitted by law.
14. International users and future services
Our services are currently offered in Kerala, India. We plan to expand internationally, starting with Dubai. Services outside India will be offered only once the required local licences, registrations and partners are in place, and may be subject to additional terms, which we will publish at that time.
15. Governing law and disputes
These terms are governed by the laws of India. If a dispute arises, we will first try to resolve it with you informally. If that is not possible, the courts at Thiruvananthapuram, Kerala will have jurisdiction, subject to any rights you have under consumer protection law.
16. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they were last changed. Continuing to use the website after a change means you accept the updated terms.
